1. Matchmaking Process
To qualify for a Miingle Membership, all applicants must satisfy the following verification and declaration criteria prior to approval:
Identity Verification: Applicants must submit a valid, unexpired government-issued identification document. Acceptable forms include a national passport, government ID card, or driver's licence.
Criminal Record Declaration: Applicants must explicitly declare and warrant that they have a completely clear criminal record.
Accuracy of Information: Falsifying this declaration or misrepresenting your criminal history will result in immediate permanent ban from the service without a refund.
Verification Rights: Miingle reserves the right to conduct independent background checks to verify the accuracy of your declaration at any time.
You understand and agree that:
- We do not guarantee that you will find a suitable partner through the Service.
- While initial verification is required for membership entry, we do not continuously monitor users and are not responsible for subsequent changes to their marital status, identity, or legal standing.
- We are not actively involved in the ongoing communication, interaction, or relationship growth between you and your matches.
- You are solely responsible for your own safety and well-being when meeting, dating,
or entering into a relationship with your matches.
- You must exercise caution and common sense when using the Service and when meeting or dating your matches.
- You must report any suspicious, abusive, or illegal behavior by other users to us immediately.
2. Client Eligibility & Accuracy
By applying for a membership, you represent and warrant that you are at least 25 years of age and that your legal marital status is single, divorced, or widowed. You certify that all information, documentation, and identification provided to Miingle is truthful, accurate, and complete. Providing false information is grounds for immediate termination without a refund.
3. Mutual Confidentiality & Non-Disclosure
Matchmaking is a private process. You agree to keep all information regarding Miingle’s processes, staff, and specifically the details of any "Introductions" (names, contact info, photos, or descriptions) strictly confidential. You may not share match details with third parties or on social media. Miingle reciprocates this by protecting your identity until an introduction is mutually agreed upon.
4. Intellectual Property Rights
Our Property: We own and retain all rights, title, and interest in and to the Service and its content, including but not limited to the trademarks, logos, designs, texts, graphics, images, videos, audios, software, and any other materials or elements. Nothing in these Terms grants you any right, license, or permission to use any of our intellectual property rights without our prior written consent.
Your Content: You own and retain all rights, title, and interest in and to the content that you post, upload, transmit, or distribute through the Service ("Your Content"). However, by doing so, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and sublicensable license to use, copy, modify, adapt, distribute, display, perform, and create derivative works from Your Content for the purposes of operating, improving, promoting, and providing the Service. You also waive any moral rights or claims that you may have in Your Content.
Your Warranties: You represent and warrant that:
Your Content is original and does not infringe or violate the rights of any other party, including their privacy, intellectual property, or contractual rights;
Your Content does not contain any unlawful, defamatory, obscene, pornographic, harassing, threatening, abusive, hateful, or otherwise objectionable material;
Your Content does not contain any viruses, worms, malware, or other harmful or destructive code.
We do not endorse, approve, or verify Your Content or any other user's content. We are not liable for any loss or damage arising from or relating to Your Content.
5. Photographic & Personal Information Usage
You grant Miingle permission to use your photographs and personal data solely for the purpose of the matchmaking process. Your profile is curated by a human matchmaker and will only be shared with potential matches once Miingle determines a high probability of compatibility.
6. Data Protection & Privacy (POPIA Compliant)
Miingle is committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA). Your data is stored securely and accessed only by authorised staff.
7. Communication & Contact Consent
By enrolling, you provide express consent for Miingle to contact you via email, telephone, SMS, or WhatsApp for the purpose of service updates, match alerts, and administrative queries.
8. Responsible Conduct
You agree to behave professionally, ethically, and respectfully in all interactions with Miingle staff and the individuals you are introduced to. Any form of harassment, rude behaviour, or breach of etiquette may result in the suspension of your membership.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to the warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, availability, or compatibility. We do not warrant that the Service will meet your requirements; be uninterrupted, error-free, or secure; or provide specific results or outcomes.
10. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising from or relating to your use of or inability to use the Service. This includes, but is not limited to, damages for loss of profits, data, reputation, personal injury, property damage, or emotional distress, even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Miingle, our affiliates, partners, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the service or your violation of these Terms.
12. Introductions & Service Discretion
Miingle reserves the right to approve or decline any application at its sole discretion. You acknowledge that matchmaking is a curated service and not a guarantee of a specific relationship outcome.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
